Gift Card Terms of Use

株式会社阪神コンテンツリンク(以下「当社」といいます。)は、当社が運営するビルボードライブの会員(第3条に定める会員登録を完了された方をいいます。)に対して提供するサービス(以下「本サービス」といいます。)に関する利用規約(以下「本規約」といいます。)を以下の通り定めます。

Article 1 (Purpose of These Terms)

1. These Terms govern the use of the Billboard Live Gift Card, defined below, issued by Hanshin Contents Link, Inc. (hereinafter referred to as the "Company"). The holder of the Billboard Live Gift Card (hereinafter referred to as the "Customer") shall transact in accordance with these Terms (hereinafter referred to as the "Terms").

2. By using this card, you are deemed to have agreed to and accepted each provision of these Terms.

3. We may add to or amend the contents of these Terms as needed, so when using the service please refer to the latest version of these Terms posted on the website operated by our company.

Article 2 (Definitions)

The definitions of terms used in these Terms shall be as follows, unless defined elsewhere.

( 1 ) Billboard Live Gift Card

‘This Card’ refers to a prepaid instrument issued by the Company (an add/subtract-type card) that stores information representing monetary value as electronic data, can be reloaded repeatedly, and allows the holder to receive services at card-accepting merchants designated in Item 4 of this Article using the loaded amount.

( 2 ) Customer

means a person who has understood, agreed to, and consented to all of the provisions of these Terms, who has received delivery of this card from the Company (including any third parties to whom the Company has delivered the card), who actually possesses the card, and who uses the card in accordance with these Terms.

(3) Billboard Live Gift Card-accepting retailers (hereinafter referred to as “card-accepting retailers”).

The following three facilities operated by our company are:

  • Billboard Live Tokyo

  • Billboard Live Osaka
    B2F, Herbis PLAZA ENT, 2-2-22 Umeda, Kita-ku, Osaka
  • Billboard Live Yokohama
    5-57-2 Kita-Naka-dori, Naka-ku, Yokohama, Kanagawa Prefecture
    KITANAKA BRICK&WHITE 1F

For details on the locations and information of specific card retailers, you may contact the Billboard Live Gift Card inquiry desk listed at the end of these Terms and Conditions by phone, or view it on our website.

(4) Services

This refers to the services our company provides to customers at card-accepting retailers (such as music fees, reservations for designated seats, in-store dining services, etc.).

(5) Value

This means the value equivalent to the circulating currency required for the customer to receive the service (Note: the remaining balance of this card as of the card’s last usage date is hereinafter referred to as the “Value Balance”).

6. Use through the provision of services

It refers to the general term for the act of receiving a service by presenting a card at a card-accepting merchant that has the required value balance.

Section 7: Deposit

Regardless of whether you have the value balance required to receive the services, with respect to this card, paying to a card-accepting merchant an amount of money equal to or greater than the amount specified in these Terms, or increasing the card’s value balance by any other method designated by the Company, is referred to as the act of increasing the card’s value balance.

(8) Value Balance Inquiry

This refers to the act of confirming the balance (the card’s value) of this card by presenting it at a merchant that accepts this card, or by any other method designated by our company.

( 9 ) Use

For the purposes of this card, deposits into the card and the use arising from the provision of the card’s services are collectively referred to as ‘use’.

(10) Coupon Value

This refers to the service value that our company has deposited for use in customer gifts and promotional campaigns.

Article 3 (Card Issuance)

Our company will issue this card at card-issuing merchants, and you will be entitled to receive the card by paying to the card-issuing merchant an amount equal to or greater than the amount specified in these Terms.

Section 4 (Use of this Card)

1. You may use this card only at merchants that accept card payments. This card cannot be used at locations other than those merchants, so please note.

2. This card can be used at card-accepting merchants to receive services using value, and depending on your usage, you may deposit incentive value granted separately by us. The deposited incentive value can be used at card-accepting merchants to obtain services in the same way as regular value.

3. This card is valid only for use at stores that handle the card, for music fees, reserved seating, and in-store dining services. Purchases of items sold in-store—such as CDs and souvenirs—and dining in the casual area are not eligible.

Article 5 (Method of Payment)

1. Deposits to this card will be accepted at card-accepting merchants.

2. The customer may load funds onto this card using the payment methods designated by the Company.

3. Deposits into this card can be made in 1,000-yen increments per transaction.

4. The maximum amount of deposits that can be accumulated on this card is up to 300,000 yen per card.

Article 6 (Method of Use)

1. When you receive services with this card, you are to present this card at the register of the card-accepting merchant. By deducting from the value loaded on this card an amount equivalent to the total cost of the services, the same effect as paying with cash is achieved. In this case, the receipt will display the total service amount and the remaining balance on this card after payment, and the customer should verify that there are no errors in them.

2. If the value balance on the card you presented is insufficient to cover the total amount of the services provided, you shall pay the shortfall in value using cash or other payment methods designated by each store, such as a credit card.

3. When paying, the number of cards that may be used for a single payment is limited to one card. If the balance is insufficient, you must pay the shortfall using a payment method designated by each store, such as cash or a credit card.

4. After processing under each provision of Article 6, the customer shall receive from the card-accepting merchant a receipt or statement, or other document designated by the Company (hereinafter simply referred to as a “Receipt”), which shows the amount used with this card and the remaining value balance on the card after that use, and the customer must confirm that there are no errors in the information described on the receipt. In addition, in this case, unless the customer makes a specific request at the time of receipt of the Receipt, it shall be deemed that the customer has confirmed that there are no errors in the information described therein.

5. Even if you have multiple cards, you cannot merge the stored-value balances of each card into a single card.

Article 7 (Method for Checking Value Balance)

1. The customer may check their Value balance by the methods described in the following items.

(1) Receipt-based value balance inquiry as specified in Article 6
(2) Value balance inquiry for this card by presenting this card at a card-accepting merchant
(3) Balance inquiry on the website designated by our company

2. If you check your value balance at the website designated by our company, you will need the 16-digit card number printed on the back of this card and the 6-digit PIN number printed on the back (if it is a scratch-off type, please gently rub the scratch-off area with a coin or similar to reveal the 6-digit number).

3. On the website designated by our company, you can view your value balance in addition to your usage history. However, due to system constraints, the types of history that can be displayed on the website and the number of history records that can be shown shall be determined by us.

Article 8 (Redemption)

1. The card itself or the value balance on this card cannot be redeemed, refunded, or reimbursed.

2. Notwithstanding the provisions of the preceding paragraph, if the company decides to completely discontinue handling of this card due to changes in social circumstances, the enactment or revision of related laws, or other circumstances of the company, the customer may, as an exception, request a refund of the stored-value balance of this card from the company. In this case, refunds shall be made in accordance with the method prescribed by the company, based on the results of the stored-value balance inquiry for this card.

3. If a refund described in the preceding paragraph is issued, the Company shall collect the card from the customer.

Article 9 (Reissuance)

1. Even if this card is lost, stolen, altered, or used by a third party without your authorization, we will not refund or reissue this card.

2. There is a risk that the card or its functions could be damaged, so please do not soil the card, bend it, or bring it near magnets.

3. If this card is damaged, or if any required functionality is impaired, and it is clearly evident that the cause is not due to the customer’s intent or negligence, and the specific number recorded on the card’s magnetic stripe or printed on the back is legible, then at the Company’s discretion, in accordance with the Company’s prescribed method, the Company will reissue a new card equipped with the function to utilize the remaining value balance.

4. In the event of reissuing this card, the Company may require you to surrender the old card in exchange for issuing the new card. In issuing the new card, the design and attributes of the card shall be specified by the Company, and you shall not object.

Section 10 (Unauthorized Acquisition and Use, etc.)

1. If any of the following apply, the Company shall deny the Customer's use of this card, deem the card itself invalid, and require the Customer to hand over the card to the Company.

(1) If the customer obtained this card by improper means, or uses it knowing that it was obtained by improper means, or intends to use it.
(2) If this card has been altered, forged, or tampered with.
(3) If you violate laws or these Terms and Conditions.
(4) If the customer is found to be a member of organized crime groups, sokaiya, or other anti-social forces (groups or individuals that pursue economic gain using violence, intimidation, or fraudulent methods).
(5) If the customer engages in violent or coercive demands, or makes improper demands beyond what is legally permissible.
(6) If the Company determines that the use of this card is fraudulent.

2. If there is suspicion of any of the items listed in the preceding paragraph, the Company may temporarily take custody of this card for the purpose of investigation.

3. The customer shall not be entitled to request any refund, reissuance, or exchange of this card, even in the case described in Paragraph 1.

Article 11 (Restrictions on the Validity Period) [Important Matters]

1. If you do not use this card for one year, counted from the date of purchase or from the day after your last use, the card will become invalid, and no refunds will be issued regardless of whether any balance remains on the card or how large it is.

2. The customer shall have no right whatsoever to make any claims for use or refunds, etc., in relation to this card whose expiration date has arrived.

3. Please take care to ensure that this card does not become deactivated if you do not use it for an extended period.

4. The coupon value is valid for one year from the date of deposit, regardless of the balance. Extension of the expiration date is possible only if you have used it. (A deposit alone will not extend it.)

Article 11-2 (Measures Relating to Customer Protection)

1. In accordance with the Funds Settlement Act (hereinafter referred to as the "Act"), we deposit a guarantee fund to safeguard the amount you have deposited onto this card. However, the deposit is made in an amount based on the standards of the Act and does not guarantee the full amount.

2. The customer shall have the right to receive payment ahead of other creditors with respect to the issuance guarantee deposit described in the preceding paragraph.

3. With respect to the issuance of this card and deposits, we shall not be liable for any losses incurred by the customer that arise from instructions given by someone who does not have authority and acts contrary to the customer's wishes, except in cases where the company (including card-handling merchants) has intentional or gross negligence.

Article 12 (System Maintenance and Outages, etc.)

While we strive to design and manage the systems related to this card with utmost care, due to power outages, system failures, maintenance, measures against card counterfeiting, and other unavoidable circumstances, the Company may temporarily suspend all or part of the card’s usage at some or all card‑accepting merchants without prior notice. In such cases, even if you incur disadvantages or damages because the card cannot be used, the Company shall not bear any liability.

Article 13 (Prohibition on the Establishment of Pledge Rights and Other Security Interests)

1. The customer shall not be permitted to grant any collateral on this card, such as a pledge.

2. The Company shall have no involvement whatsoever in any disputes or other troubles arising from the Customer's breach of the preceding clause, and shall not bear any liability.

Article 14 (Jurisdiction)

In the event of any dispute between you and the Company regarding your use of or transactions under these Terms, the exclusive court of first instance by mutual agreement shall be the Osaka Summary Court or Osaka District Court having jurisdiction over the Company’s head office.

Article 15 (Changes to these Terms)

1. Each provision of these Terms may be amended in the event of changes in social conditions or other reasonable necessity, provided that such amendments do not contravene the purpose of the contract and are made within a reasonable scope.

2. In connection with changes to these Terms under the preceding paragraph, the content of the amended Terms and the effective date shall be published in advance by means such as the Internet or other appropriate methods, and they shall apply from the day on which the reasonable period specified at the time of publication has elapsed.

3. If you use this card after changes to these Terms have been made, you will be deemed to have accepted the changes.
